LUSIJOIA.PT TERMS AND CONDITIONS
1. Introduction
The purpose of these terms is to establish the conditions of use and purchase and sale on the website belonging to FAR EQUATION UNIPESSOAL LDA (hereinafter “LUSIJOIA”) by the User or Customer (as defined below).
The commercial entity FAR EQUATION UNIPESSOAL, LDA, owner of www.lusijoia.pt, is a Portuguese commercial company, with headquarters at Rua Elias Garcia, 241 1st floor, store 11, 2700-320 Amadora | Portugal, with NIPC 514326719 and share capital of €5000.00. Dedicated to the activity of jewelry retailing through a physical store (at the address above) and online store, holder of licenses NºL340310 and l270022, authorized to practice the activity of jewelry retailing with and without establishment by the Activity Titles with the Nº T2669 and Nº T3324, all issued by Imprensa Nacional – Casa da Moeda Contrastaria Lisboa (hereinafter, INCM).
In order to complete any transaction on the website www.lusijoia.pt, the Customer is required to select the option box “I accept the Terms and Conditions and the Privacy Policy”.
By selecting this option, the Customer declares that they are a person capable of contracting, and that they have read and are fully aware of the terms and conditions specified below, which they expressly accept.
For greater understanding, the following definitions should be taken into account:
i. LUSIJOIA: The commercial company that operates the site, better identified above;
ii. Online store: the website lusijoia.pt;
iii. Customer: whoever purchases products through the online store;
iv. User: anyone who browses the online Store;
v. Products: all pieces of jewelry available for purchase in the online store;
vi. Order form: the form filled out by the User in order to complete an order on the website.
2. Scope and Object of the General Conditions of the Online Store
These General Conditions are intended, as well as the order form, to regulate the terms and conditions by which sales through the Online Store will be governed. The economic operator's contact details can be found on the Legal Information page.
The service consists of making available, through the Online Store, products for sale (gold and silver jewelry), which can be purchased by the User under the terms and conditions described here.
The order of Products must be placed by Users aged 18 (eighteen) years or over (individuals aged under but over 16 will have to have authorization from their representatives). The elements and information transmitted by the User will enjoy full legal effects, with the User recognizing electronic purchases, and the User cannot claim the lack of signature for non-compliance with the obligations assumed.
LUSIJOIA reserves the right, on its own initiative, and at any time, to correct any error or omission, or any general change to the website, including changes to these terms and conditions, without prior notice.
LUSIJOIA will not be responsible for losses and inconveniences arising from the risks inherent in the use of the Internet, including, for example, as a result of the disruption or deficiency of service and access, external intrusion or the presence of computer viruses, or any case of force bigger.
3. Products
LUSIJOIA has a variety of items in precious metals (platinum, gold, palladium and silver) for sale that are produced, mainly, through manual processes, with quality raw materials and subject to exhaustive quality control and compliance with Portuguese legislation. The Customer may, in case of doubt about the authenticity of the marks, resort to the services of Assay Offices for verification purposes.
Under subparagraph a) of no. 1 of article 63 of the RJOC law (Law no. 98/2015 of 18 August), we inform that the daily prices of gold, silver, platinum and palladium can be consulted here or by connecting to Banco de Portugal website.
The hallmark guarantees the species and feel of the precious metal of articles with precious metals, duly hallmarked. In compliance with paragraph b) of paragraph 1 of article 63 of the RJOC, the official model hallmark chart, issued by INCM.

In this sense, and in accordance with no. 3 of article 63 of the RJOC, we make available here the list of registered evaluators of articles with precious metals and gemological materials, managed and organized by INCM, and the Customer may choose to request an evaluation before purchasing or disposing of the Product.
3.1. Product Prices
Each item presents the value detailed on the website at the date of the consultation, including VAT (value added tax of 23%). Shipping costs will be added to the order value (you can find more information on the shipping and deliveries page). The total order value will be indicated before confirming the purchase.
3.2. Deliveries
Delivery will be made to the address indicated by the Customer on the Order Form, and will be dispatched within a maximum period of 10 working days from the date of the order. For security reasons, LUSIJOIA does not deliver to PO Boxes. For more details, see the shipping and deliveries page.
4. Responsibility for errors
LUSIJOIA will do everything possible to ensure the accuracy of the information on the website, as well as to only publish in the online store the products it has available for delivery. However, it is possible that, in certain cases and due to causes beyond LUSIJOIA's control, such as incidents in IT systems, or due to human error, it may not be possible to deliver any of the products ordered by the Customer. In these specific cases of stock outages, in which the product is not available after placing the order, the Customer will be notified of the fact by email or telephone call. At that moment you will be presented with the possibility of canceling the order with a full refund, if you have already made the respective payment.
All information about price, products, specifications, promotional actions and services may be changed at any time by LUSIJOIA.
We guarantee that, upon delivery of the Products, they comply with their description, are of satisfactory quality, are fit for purpose, do not present defects, and that they comply with legal requirements.
5. Data processing
LUSIJOIA undertakes to keep confidential and treat all personal data or customer information in accordance with the Privacy Policy. By accepting it, the Customer has the following obligations:
i. Declare that you are over 18 years old to have the legal capacity to enter into contracts.
ii. Do not carry out fraudulent acts, namely using third-party cards for payments without your knowledge. LUSIJOIA is not responsible for any legal consequences.
iii. Provide LUSIJOIA with all the information requested and necessary to execute the order: name, address, contacts, type of payment.
iv. Refrain from introducing, storing or disseminating through the website defamatory, obscene, insulting, xenophobic and/or any other content that violates the general principles of law and public order.
The User does not have the right to copy or use any content from the online Store: the images, brand/logo, text, files, product names, slogans and product photographs are the intellectual property of LUSIJÓIA that are protected by laws and registered trademarks , copyright and other intellectual property laws.
6 - Order cancellation and free resolution
6.1. Free resolution
Order cancellation and Pursuant to article 10 of DL no. 24/2014, of February 14, the Customer has the right to terminate the contract without needing to indicate the reason, within 14 days of receipt of the order, by sending an email to this effect to info@lusijoia.pt.
In the email, the Customer must indicate the order number, NIF and delivery address associated with it.
The Customer must then return the product by sending it by CTT to the LUSIJOIA headquarters address identified above. The Customer will bear the return costs.
Upon exercising the right of free resolution under the terms above, LUSIJOIA will reimburse the Customer for all payments received, including the costs of delivering the order, through the same payment method that was used by the Customer.
The refund will be withheld until the products are received by LUSIJOIA.
6.2. Prior cancellation at the User's request
The Customer may cancel their order by requesting it to LUSIJOIA via telephone number or email, which will be accepted as long as (i) the cancellation request is made within 48 hours of the order being placed and (ii) it has not yet been processed. After accepting the cancellation request, LUSIJOIA will cancel delivery of the order and refund the Customer in full, using the same payment method they used. For the purpose of cancellation, the Customer must provide the following data to LUSIJOIA: (i) order number; (ii) NIF associated with the order; and (iii) delivery address.
6.3. Cancellation by decision of LUSIJOIA
LUSIJOIA reserves the right not to process orders, when it finds any inconsistency in the personal data presented, when there is non-compliance with the Customer's legal or contractual duties or in the event of their misconduct. LUSIJOIA reserves the right not to process any order, in the event of errors in the values and/or characteristics of the products, when these arise from technical problems or errors beyond the control of LUSIJOIA.
7. Communications
All communications with LUSIJOIA must be made using the contact details provided on the website.
8. Complaints
LUSIJOIA has a Complaints Book.
In case of conflict, the Customer may resort to Arbitration Centers.
9. Applicable Law
The terms are governed by Portuguese Law, namely by the Legal Regime of goldsmithing and assay offices (Law 98/2015 of August 18th) and by DL no. 24/2014, of February 14th), in the versions given by DL n. 9/2021, of 29/01.
